IAA secures first-ever prosecution of airline over passenger rights breaches

The Irish Aviation Authority has noted the successful prosecution of FlyOne SRL for failing to comply with statutory directions related to air passenger rights under EU Regulation 261/2004. The case involved nine separate passenger claims for compensation or refunds following flight disruptions with a total amount due of €4,372.70. FlyOne did not appear in court and was found guilty on all nine offences.

The court imposed a fine of €4,500 on FlyOne along with a contribution to the IAA’s costs. The judge expressed the view that FlyOne should compensate the affected passengers. This marks the first time the IAA has prosecuted an airline specifically for passenger rights offences.

Clare Mulcahy shared As Ireland’s Civil Aviation Regulator, ensuring compliance with European consumer protection legislation for air passenger rights is a priority. Passengers must receive the compensation and refunds they are entitled to under the law. 

The IAA syas it will take robust enforcement action, including prosecution where necessary, to uphold passenger rights and hold airlines accountable for breaches of the air passenger rights legislation.
