‘False urgency claims’ – Brussels court orders Ryanair to cease certain marketing practices

The Brussels Commercial Court has ruled that Ryanair must stop specific commercial practices deemed misleading in Belgium including fake reference discounts and false urgency claims about seat availability and incomplete disclosure of round-trip luggage fees. 

The decision upholds complaints from consumer group Testachats while rejecting challenges to cabin baggage charges seat selection fees and demand-based pricing finding them compliant with EU law. Non-compliance carries a penalty of €5000 per day and Ryanair welcomed the confirmation of its core policies. 

The primary developments encompass order to end misleading discount advertising, prohibition on urgency tactics and partial fee disclosure, upholding of baggage and seat fees, €5000 daily penalty for breaches, and partial victory for both Ryanair and consumer advocates.

Testachats spokesman Jean-Philippe Ducart shared “We welcome this major decision in favour of consumer rights which reaffirms their right to be properly informed without manipulation and the use of ‘dark patterns’ so that they can make fully informed decisions“.

A Ryanair spokesperson shared in a written statement “Ryanair welcomed the ruling saying it confirmed its cabin baggage policy complies with EU rules and case law“.
