
Acass Ireland Ltd is pursuing a €1.19m claim against Amborella Ltd in the Commercial Court, with mediation being agreed upon by both parties, under Mr Justice Mark Sanfey.
The dispute revolves around an aircraft management agreement from October 2022, in which Acass operated a private jet owned by Amborella, whose beneficial owners are Tommy Kelly and Barry English.
Amborella has counterclaimed €2.2m and has questioned a payment of €527,000 claimed by Acass, making a part payment of €100,000 in September 2024.
If mediation fails, the case is scheduled to return to court in March for further proceedings regarding the owed sums and the aircraft’s potential transfer to a Hamburg-based company.
The lawsuit relates to a disputed agreement tied to the management of a Cessna 560 XLS Plus, while Amborella has counterclaimed EUR2.2m (USD2.3m).
The aircraft is EJ-PRLN (msn 560-6003) which Acass began managing it on behalf of Amborella in December 2022.
The agreement established in October 2022 permitted ACASS to manage the aircraft for five years and charter it as necessary; however, a December 2023 assessment indicated that maintenance requirements for 2024 would surpass €500,000.
Although Amborella made a partial payment of €100,000, they attempted to transfer the aircraft to another management firm prior to the contract’s completion, prompting ACASS to seek €933,000 for outstanding maintenance costs, now totaling €1.19m.
At a hearing on January 27, 2025, in Ireland’s Commercial Court, Justice Mark Sanfey learned that both parties had consented to mediation, and a subsequent court date is scheduled for March 2025 to determine the case’s direction based on mediation results.
