
Boeing has requested a US federal court to dismiss a lawsuit from the estate of Comair (South Africa), which is seeking $83m for allegedly fraudulent practices related to B737 MAX aircraft deposits.
The dispute centres around a claimed “letter of comfort” from Boeing that promised refundable deposits, which Boeing asserts does not exist and was part of routine document deletion policies.
Comair argues that the letter supporting their case was inconsistent, dated January 2024, ten years after it was allegedly sent, raising questions about its authenticity.
Boeing defends its document retention practices, explaining that it routinely deletes documents from departing employees if no litigation hold is in effect, which was the case when key personnel left.
The trial contemplates whether Boeing should have anticipated litigation as early as 2012 due to allegations of fraud regarding the B737 MAX, which Boeing contests as unreasonable.
