
Nicolae and Florin Mazarache of Clondalkin, Dublin, have lost their High Court appeal against €2,000 fixed penalty notices for breaching Covid regulations on 17 April 2021.
The father and son received the notices after a garda stopped them at Dublin Airport while travelling to Spain to visit family members.They chose judicial review proceedings instead of paying the fines alleging an offence of movement of persons at a port or airport contrary to the 1947 Health Act as amended.
The court dismissed the challenge finding the notices valid under the regulations in place.
The Mazaraches argued the fixed payment notice failed to cite a specific regulation showing jurisdiction on its face.
