Ryanair welcomes three Italian court rulings against ENAC overturning fines over cancellations

Ryanair has expressed its approval of recent judicial decisions in Italy that overturned fines imposed by the country’s aviation authority. The airline highlighted victories in courts located in Bologna and Bari, where three sanctions from 2022 were declared invalid. These rulings came after Ryanair challenged the penalties, arguing they were unjustly applied to flight disruptions.

The courts determined that the cancellations in question resulted from extraordinary situations beyond the airline’s control. Factors such as delays in air traffic control were cited as key reasons for the disruptions. This classification of events as exceptional meant the fines could not legally stand, leading to their annulment.

As a result of these judgements, Ryanair is entitled to refunds for the amounts previously paid. The decisions reinforce the airline’s position on liability in cases of unforeseen operational issues. This outcome may influence future interactions between airlines and regulatory bodies in Italy regarding similar disputes.

Ryanair shared in a written statement “In each case, the Italian courts established that the related flight cancellations were caused by exceptional circumstances including air traffic control delays.”
