
The High Court has ruled in favour of On the Beach, stating that Ryanair must refund flights that were cancelled or significantly changed during the pandemic to the OTA rather than directly to customers.
Ryanair welcomed the ruling, they stated that customers can directly claim refunds from them and do not need to go through On the Beach since there is no commercial agreement between them.
The court found that Ryanair had no grounds to defend the claims made by On the Beach regarding the refund obligations under regulations and unjust enrichment.
On the Beach has been awarded approximately £2m and plans to recover its legal costs as well.
On the Beach will now begin the process of recovering money in cases where Ryanair has not yet provided a refund but On the Beach has reimbursed its customers.
On the Beach’s CEO, Shaun Morton, expressed their satisfaction with the court’s decision and highlighted the importance of handling refunds appropriately.
