Ryanair & Aer Lingus join forces with Dublin Airport in court bid to prevent night flights being cancelled

Ryanair and Aer Lingus will join with Dublin Airport in a High Court challenge to prevent night time flights being cancelled at the airport, opposing a notice directing the operator of Dublin Airport to restrict night-time flights to a maximum of 65 per night.

The airlines are joining the airport in opposing an enforcement order by Fingal County Council enforcement notice, which was issued on the grounds that the number of flights scheduled by the airport exceeds the terms of a planning condition regarding runway operations between 11pm and 7am.

Last August, the Dublin Airport Authority secured a court order pausing the effect of the notice.

Flights at night-time accounted for 73pc of all noise complaints at Dublin Airport in the first six months of 2023.

The High court heard the council stands over the validity of its enforcement notice but has not sought to lift the High Court’s stay on the order. The order remains in place while the dispute over its legitimacy is ongoing.
