Dublin City Council has won its appeal regarding the construction of a cycleway on Sandymount’s Strand Road.

The High Court previously ruled that planning permission was necessary for the scheme, which prompted an appeal from the council.

Implications of the High Court ruling could have affected the council’s capacity to develop other cycleways and implement traffic calming measures.

The Court of Appeal found that the original High Court judge lacked sufficient information on the council’s decision-making procedures.

The counter appeal by Councillor Mannix Flynn was dismissed as it could have severe implications for the functions of Dublin City Council.

The findings of the High Court – if upheld – would have serious implications for the executive functions of Dublin City Council. The original High Court judge did not have adequate information about the local authority’s decision-making process.
