Ryanair claims Garda raid was conducted with an invalid warrant

Ryanair claims the search of its premises by competition authorities in Ireland and Italy, accompanied by gardaí, was conducted with an invalid warrant due to lack of important information being provided to the issuing judge.

The airline is seeking to have the warrant quashed on the grounds of breach of fundamental rights and incorrect information.

Thirty officers from both authorities conducted an unannounced inspection of Ryanair’s premises in Swords, north Dublin.

Ryanair’s head of competition states that the Italian competition authority has opened an investigation into the airline for possible abuse of a dominant market position.

Ryanair rejects the allegations of abuse of position and points to decisions of the Court of Appeal of Milan in their favour.

Ryanair is requesting the court to declare the seized material as tainted by illegality and inadmissible, and to return it to Ireland, asserting rights to damages for breach of duty and constitutional rights.
