
The Workplace Relations Commission (WRC) has upheld the dismissal of Gerard Carey, an airside operations manager with Dublin Airport Authority since 1998, who was dismissed for gross misconduct in August 2024 following his arrest for theft from terminal shops on June 29, 2023.
The WRC ruled that a comprehensive investigation and disciplinary process were conducted, supporting the need for trust in airport operations.
Carey’s union argued that his mental health issues were not adequately considered during the disciplinary process, which they claimed showed a failure in the Dublin Airport Authority’s duty of care.
The WRC’s decision determined that the rules of natural justice were observed, concluding that no case for unfair dismissal was established, and also dismissed Carey’s claim for statutory notice pay related to the gross misconduct findings.
Vivian Cullen of trade union Siptu, appearing for Mr Carey, submitted medical evidence which indicated his client “had been suffering from severe mental issues relating to changes in life [and]family circumstances and family illnesses”.
