An Bord Pleanála’s decision to grant permission for a hotel near the Royal Hospital Kilmainham has faced a High Court challenge by engineer & architect Paul Leech and author & journalist Frank McDonald, who argue that the proposed development will negatively impact the historic building and surrounding area

The challenge asserts that the board’s decision to grant planning permission for the hotel in Dublin 8 was flawed and should be set aside, despite Dublin City Council previously refusing permission for the project

The applicants, represented by legal counsel, seek orders and declarations from the court, including an order to quash the board’s decision, citing grounds such as non-compliance with fair procedures, irrationality, and errors in judgment regarding the Dublin City Development Plan

The High Court action, with the developer as a notice party, challenges the jurisdiction of the board in granting permission, and the case has been adjourned to a date in May after a brief mention before Ms Justice Carmel Stewart, where the application was formally opened.
